General Conditions of Sale

These terms and conditions are intended to define the terms of sale between Kimologylab and the user, from ordering to services, including payment and delivery. They govern all the steps necessary for placing the order and ensure the tracking of this order between the contracting parties. As the General Terms and Conditions of Sale are subject to change, the new general terms and conditions of sale will take effect on the date they are published on Kimologylab.com.

The buyer will be asked, with each order, to confirm acceptance of the general terms and conditions of sale in force on the date the order is placed. The buyer's submission of the order form will constitute unconditional acknowledgement and acceptance of these General Terms and Conditions of Sale.

1. Price

Prices are indicated on the Site in euros, all taxes included (TTC), excluding shipping costs. They take into account VAT and any discounts applicable on the day of the Order.

Any new taxes or contributions, particularly environmental ones, may be reflected either upwards or downwards in the selling price of the Articles.
Customs fees and other taxes are not included in the price paid by the Customer. These fees must be paid by the Customer directly to the carrier.

Kimologylab.com reserves the right to change prices at any time.

2. Order

Any order constitutes acceptance of the prices and descriptions of the products available for sale, as well as the general terms and conditions of sale. Any dispute on this point will be subject to a possible exchange and the guarantees mentioned below.

Kimologylab.com undertakes to fulfill orders received on the website only within the limits of available product stocks. In the event that a product is unavailable, Kimologylab.com undertakes to inform the user.

3. Delivery

Products are shipped by Kimologylab.com to the delivery address indicated by the buyer during the ordering process.

Kimologylab.com delivers to mainland France and Monaco, but does not deliver to the French overseas territories. Kimologylab.com delivers orders within a maximum period of 2-4 working days for delivery in mainland France and 12 working days for international delivery. Kimologylab.com cannot be held responsible for delays in delivery that are not its fault or justified by force majeure (as defined below).

Shipping costs: Shipping is free in mainland France. For 23 other international countries, shipping costs are €10. Deliveries are handled by Colissimo (a postal service) and Chronopost from Monday to Friday, depending on the option chosen by the Customer when confirming their Order. You can track your package at any time on the Chronopost or La Poste website.

4. Returns and Refunds

Items purchased on Kimologylab.com may be returned if the following conditions are met:

  • Items must be returned in their original, unused condition, with tags and packaging.
  • Return requests must be made within fourteen (14) days of receipt of the order.

The return of the Products is the responsibility of the Customer.

Once the returned Item(s) have been checked upon receipt of the return, Kimologylab.com undertakes to reimburse the Customer as soon as possible following notification of receipt of the return.

All sums paid for the Article concerned will be refunded to the Customer, to the Customer's bank account or payment account used for payment of the Article(s), under their Order.


5. Refusal to process an order

Kimologylab.com reserves the right to withdraw any product from this website at any time and to replace or modify any content or information contained therein. Although Kimologylab.com always makes every effort to fulfill all orders, exceptional circumstances may arise, such as a manufacturing, inventory, or payment incident, which may require Kimologylab.com to refuse to process an order after sending the Order Confirmation. Kimologylab.com reserves this right at any time.

In this case, if the payment has already been made, Kimologylab.com will refund all amounts paid, including delivery costs, as soon as possible, using the same payment method used for the transaction. This refund will not incur any fees for you.

Kimologylab.com shall not be liable to you or any third party for the removal of a product from this website, the removal or modification of a product or content appearing thereon, or the failure to process an order in the cases referred to above, after sending the Order Confirmation.


6. Guarantees and Disputes

All items are subject to a contractual warranty, which does not preclude the legal warranty provided for by Articles 1641 et seq. of the Civil Code. The user also benefits from a warranty allowing him to return defective items delivered in accordance with Articles L 211-4 et seq. of the Consumer Code. The user is therefore invited to refer to these texts if he wishes to have more details on these legal guarantees.

Any disputes concerning a sale concluded in application of these general conditions of sale – concerning their validity, their interpretation, their execution, their termination, their consequences and their follow-ups – and which could not be resolved between Kimologylab.com and the customer, may be submitted to the competent courts under the conditions of common law.

In the event of a dispute, the customer is informed that he may in any event resort to conventional mediation in order to find an amicable solution before any legal action, in particular with the Consumer Mediation Commission (C. consom. art. L 612-1) or with existing sectoral mediation bodies, the references of which appear on the website www.cm2c.net .

7. Complaints

Upon receipt of the items, the customer must immediately check their condition and conformity with the order, including quality, quantity, and characteristics. If the items do not conform to the order or are damaged, the customer must make reservations and complaints to the carrier or refuse delivery if the package is open or damaged.

Complaints should be sent by email to Kimologylab@gmail.com within 15 days of delivery. The customer must specify and justify in detail the reasons for their complaint.

No spontaneous returns without prior agreement from Kimologylab.com will be accepted, except in the case of exercising the right of withdrawal.

8. Legal guarantee

The items sold are covered by the legal guarantee of conformity provided for in Articles L. 217-4 to L. 217-13 of the Consumer Code, as well as by the guarantee of hidden defects provided for in Articles 1641 to 1648 and 2232 of the Civil Code.

In accordance with the provisions of Article L. 217-15 of the Consumer Code, Articles L. 217-4, L. 217-5 and L. 217-12 of the Consumer Code as well as Article 1641 and the first paragraph of Article 1648 of the Civil Code are reproduced in full below:

Article L. 217-4 of the Consumer Code

“The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity that exists at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility under the contract or has been carried out under his responsibility.”

Article L. 217-5 of the Consumer Code

“The good is in conformity with the contract: 1° If it is suitable for the use usually expected of a similar good and, where applicable: - if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model; - if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling;

2° Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.”

Article L. 217-12 of the Consumer Code

“The action resulting from the lack of conformity is prescribed after two years from the delivery of the goods.”

Article 1641 of the Civil Code

“The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.”

Article 1648 paragraph 1 of the Civil Code

“The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.”

Except in the cases provided for in these General Terms and Conditions, the items sold are neither returned nor exchanged. When acting under the legal guarantee of conformity, the consumer: * benefits from a period of 2 (two) years from delivery of the goods to act; * can choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code; * is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 (twenty-four) months following delivery of the goods. The legal guarantee of conformity applies independently of the commercial guarantee granted. The consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, he may choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

9. Liability

The products offered comply with current French legislation and regulations. It is the buyer's responsibility to check with the local authorities in their country regarding the possibilities of importing or using the products ordered.

Kimologylab.com cannot be held responsible for the non-performance of the contract concluded, due to the occurrence of a force majeure event, in particular in the event of a total or partial strike of postal services, carriers, and disasters caused by floods or fires.

With respect to products purchased for professional purposes, Kimologylab.com shall not be liable for any indirect damages arising from these terms, including loss of business, loss of profit, damages, or expenses that may arise. The selection and purchase of products or services are the sole responsibility of the customer.
